Section 1135 of the Social Security Act [42 USC §1320b5] permits
the Secretary of Health and Human Services to waive certain regulatory requirements
for healthcare facilities in response to emergencies. Two conditions
must be met for the Secretary to be able to issue such "1135 waivers":
first, the Secretary must have declared a Public Health Emergency; second,
the President must have declared a National Emergency either through a Stafford
Act Declaration or National Emergencies act Declaration. If these
conditions are met, then healthcare facilities may petition for 1135 waivers
in response to particular needs, and only within the geographic and temporal
limits of the emergency declarations.
The 1135 waiver has been used before: Hurricane Katrina (2005), Hurricanes
Ike and Gustav (2008), and the North Dakota flooding (2009).
We, the People of these United States of America, hereby call for
revolutionary changes in our health care system that encourage health and

have approved the use of ionizing radiation for fresh spinach and lettuce,
saying the technique already approved for other foods can help control harmful
bacteria and other pathogens. The Food and Drug Administration said on Thursday
the radiation treatment also would make the leafy greens last longer and
give them greater "shelf-life" for retailers and consumers. Foods
already approved for radiation treatment include meat, poultry, spices and
molluscan shellfish such as oysters, mussels and clams, according to the
agency.
Eating Fish May Benefit Aging Brains
: Most of us have heard that fish is "brain food'. The benefits
of Omega 3's from fish oils are well documented. According to a newer study,
moderate consumption of tuna and other fish may improve the health of white
matter in the brain of elders, helping to preserve memory and other cognitive
skills.
HOW TO REDUCE THE RISK OF CANCER FROM GRILLED MEATS
Americans love their grilled meat, and so the discovery a few years ago
that grilling creates carcinogens dismayed untold numbers of people. But
worry no more, there are some easy solutions -- scientifically validated
and tasty, too. Common spices -- rosemary, but also other members of the
mint family including basil, oregano, sage, savory, marjoram and thyme
-- can be used to reduce or block the formation of cancer-causing substances.
The carcinogens formed in grilled meat are called heterocyclic amines,
or HCAs. Scientists at Kansas State University in Manhattan, Kansas, have
been studying HCAs, hoping to find ways to reduce or eliminate them so people
can continue to enjoy this summertime favorite. J. Scott Smith, PhD, professor
of food chemistry and toxicology and head of the project, told me that the
process of grilling creates HCAs in all meats, including beef, pork, chicken
and fish. His team found that rosemary can reduce the formation of HCAs
by at least 30% and sometimes completely. Sprinkling fresh rosemary directly
on uncooked chicken or fish or marinating it in, say, olive oil with rosemary,
does protect against HCA formation.

Outbreak in Tomatoes: The Food and Drug Administration is alerting
consumers nationwide that a salmonellosis outbreak appears to be linked
to consumption of certain types of raw red tomatoes and products containing
raw red tomatoes. The bacteria causing the illnesses are Salmonella
serotype Saintpaul, an uncommon type of Salmonella.
The specific type and source of tomatoes are under investigation. However,
preliminary data suggest that raw red plum, raw red Roma, or raw round red
tomatoes are the cause. At this time, consumers should limit their tomato
consumption to tomatoes that have not been implicated in the outbreak. These
include cherry tomatoes, grape tomatoes, tomatoes sold with the vine still
attached, and tomatoes grown at home.

FDA CRACKS DOWN ON NATURAL HERBAL SWEETENER, STEVIA
The FDA, under pressure from the powerful sugar and artificial sweetener
lobby, has issued a warning letter to Celestial Seasonings for using a popular
natural sweetener in some of its teas. The letter indicates the FDA classifies
the herb stevia as "unsafe", even though it is a main staple sweetener
in countries like China and Japan and has been used without negative health
effects by indigenous people for at least 400 years. In the FDA's letter
to Celestial Seasonings, the agency aggressively condemns the use of the
herb, noting that "enforcement action may include seizure of violative
products". The FDA claims no evidence has been provided to the agency
regarding the herb's safety, but federal records reveal the FDA has received
over a thousand scientific studies regarding stevia, and all but one of
them verify the safety of the herb. In sharp contrast, nearly half of the
studies provided to the FDA regarding the artificial sweetener aspartame,
previously owned by Monsanto, indicate serious health concerns, yet it is
one of the most commonly used (and one of the most profitable) sweeteners

ALERT: GENETICALLY ENGINEERED SUGAR
TO HIT STORES IN 2008
American Crystal, a large Wyoming-based sugar company, who ironically
have launched an "organic" line of their sugar,and several other
leading U.S. sugar providers have announced they will be sourcing their
sugar from genetically engineered (GE) sugar beets beginning this year and
arriving in stores in 2008. Like GE corn and GE soy, products containing
GE sugar will not be labeled as such. Since half of the granulated sugar
in the U.S. comes from sugar beets, a move towards biotech beets marks a
dramatic alteration of the U.S. food supply. These sugars, along with GE
corn and soy, are found in many conventional food products, so consumers
will be exposed to genetically engineered ingredients in just about every
non-organic multiple-ingredient product they purchase.
The GE sugar beet is designed to withstand strong doses of Monsanto's
controversial broad spectrum Roundup herbicide. Studies indicate farmers
planting "Roundup Ready" corn and soy spray large amounts of the
herbicide, contaminating both soil and water. Farmers planting GE sugar
beets are told they may be able to apply the herbicide up to five times
per year. Sugar beets are grown on 1.4 million acres by 12,000 farmers in
the U.S. from Oregon to Minnesota.
Meanwhile candy companies like Hershey's are urging farmers not to plant
GE sugar beets, noting that consumer surveys suggest resistance to the product.
In addition the European Union has not approved GE sugar beets for human
consumption.

Artificial
colors tied to hyperactivity : LONDON, Sept. 6 Britain's Food Standards
Agency is advising parents that certain artificial colors may be linked
to hyperactivity in children.
Under pressure from industrial agriculture lobbyists, the USDA has quietly
approved a new regulation that will effectively end distribution of raw
almonds, while putting many family farmers out of business. The regulation
is scheduled to go into effect in just a few short days on September 1st,
unless thousands of consumers take action now.
The rule requires pasteurization of almonds, including organic, yet allows
those same almonds to continue to be labeled as "raw". Nutritionists
point out that raw, organic almonds are far superior, in terms of nutrition,
than pasteurized almonds.
One of the FDA-recommended pasteurization methods requires the use of
propylene oxide, which is classified as a "possible human carcinogen"
by the International Agency for Research on Cancer and is banned in Canada,
Mexico, and the European Union.
Organic and family-scale almond farmers are protesting the proposed rule,
saying it will effectively put them out of business, since the minimum price
for the pasteurization equipment is $500,000.
The agency claims pasteurization is necessary, since there have been
two food contamination incidents with raw almonds since 2001.
But both of these incidents, in fact, were the result of blatant mismanagement

Researchers at Massachusetts General Hospital have reported that omega-3
fatty acid is highly effective in treating children with ADD, ADHD and bipolar
disorder. The study was reported in the journal European Neuropsychopharmacology
in February 2007.
Report links power lines to cancer - SYDNEY, Aug. 24 An Australian
study says living next to high-voltage power lines increases the risk of
cancer. Researchers from the University of Tasmania and Britain's Bristol
University looked at a database of 850 patients in Tasmania diagnosed with
lymphatic and bone marrow cancers between 1972 and 1980, and found that
living for a prolonged period near high-voltage power lines may increase
the risk of leukemia, lymphoma and related conditions later in life. Those
who lived within 328 yards of a power line up to age 5 were five times more
likely to develop cancer, while those who lived that close to a power line
at any point during their first 15 years were three times more likely to
develop cancer as an adult, the newspaper said.

Yoga effective in lowering blood pressure - A U.S. review of 12
published randomized trials found favorable effects of mind-body therapies
on blood pressure -- with yoga the most beneficial. Ather Ali, Dr. David
L. Katz and Michael B. Bracken of Yale University conducted a systematic
review to assess the efficacy of mind-body therapies -- mediation, yoga
and visualization -- versus placebo or active control in the treatment of
hypertension.
The review found mind-body therapies significantly reduced systolic blood
pressure by a mean 11.52 mm Hg and diastolic blood pressure by 6.83 mm Hg.
Significant results were seen in systolic blood pressure reductions by yoga
and meditation therapy, while only yoga therapies demonstrated significant
reductions in diastolic blood pressure. "This review shows that there
is some high quality scientific literature supporting the use of mind-body
therapies as a treatment for hypertension, and the magnitude of effect is
clinically significant," Ali said in a statement.

for the Democrats) has reintroduced S.654 under the pretext of the
need for food safety protection, thereby creating a new federal food safety
agency. This is very dangerous legislation for consumers of dietary supplements
as it would repeal the DSHEA Act of 1994, and if signed into law, as currently
proposed, dietary supplements would be reclassified and regulated like drugs.
The companion bill, H.R. 1148, was introduced by Congresswoman Rosa
DeLauro. Both introduced similar legislation at the end of the last Congress.

Pet death toll may rise

NEW CONGRESS SCOLDS FDA FOR NOT DOING ITS JOB IN PROTECTING
PUBLIC HEALTH
FDA Bureaucrats received a kick in the butt this week from Senator Edward
M. Kennedy (D-MA), the newly elected chairman of the Senate Committee on
Health, Education, Labor, and Pensions. Kennedy slammed the FDA for endangering
public health by ignoring science and serving as a puppet for big business.
"The dedicated professionals at the FDA have been pressured to trim
their scientific views to the prevailing political winds. These are symptoms
of a serious illness, and we should act without delay to provide the cure,"
the senator said. Kennedy said the committee will hold a series of FDA oversight
hearings in early 2007 to force the agency back on track. FDA advocates
responded by saying the agency can only become scientifically credible if
Congress increases the FDA's budget in order to supplant the millions of
dollars it now receives from industry.
A survey of over 9,000 Americans found that an overwhelming majority
of people had no idea their flu shots contain mercury. "More than 75
percent of Americans feel a mercury-containing flu shot should not be given
to a pregnant woman or a child," said Lisa Handley, a founding parent
of PutChildrenFirst.org, the group that organized the survey. Handley's
own son, Jamison, had an adverse reaction to a flu shot containing mercury
in 2003. "I know firsthand how life-changing a flu shot with mercury
can be, since our son began his regression into autism after his flu shot."
In 1999, government agencies called for the removal of Thimerosal, the mercury-based
preservative in most vaccines. Then, in 2001, the American Academy of Pediatrics
stated that, "mercury in all of its forms is toxic to the fetus and
children." Despite these actions, 90 percent of this season's flu vaccines
still contain Thimerosal.

Proteins anchor memories in our brain
21-Nov-2006: A University of Utah study suggests that memories are held
in our brains because certain proteins serve as anchors, holding other proteins
in place to strengthen synapses, which are connections between nerve cells.
.."The essential idea is that synapses are in a constant state of flux,
so how can they be the seat of memories that can last a lifetime?"
says mathematics Professor Paul Bressloff, a member of the Brain Institute
at the University of Utah. "Part of the answer is that there are anchors
inside the synapse that keep proteins in place, and these proteins help
determine how strong a synapse is, which in turn contributes to forming
and retaining memories."
The research is relevant not only to how memory and learning work, but
to Alzheimer's disease, which is believed to involve, at least in part,
a breakdown in the normal movement of proteins within synapses. Click

in the thymus, where the immune system's T cells develop, if T cells fail
